8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAP COFFEE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This limitation applies to:

• Errors, mistakes, or inaccuracies in content
• Personal injury or property damage resulting from your use of the Services
• Unauthorized access to or use of our servers or personal information
• Interruption or cessation of the Services
• Bugs, viruses, or harmful code transmitted through the Services
• Loss or damage from user-generated content or interactions
• Issues arising from visits to coffee shops or attendance at events

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED $100 USD.

9. Indemnification

You agree to indemnify, defend, and hold harmless Crap Coffee, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Services
• Your user-generated content
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us at store@crap.coffee or through your account settings.

10.2 Termination by Us

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice, for any reason including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our sole discretion

10.3 Effect of Termination

Upon termination:

• Your right to access and use the Services will immediately cease
• We may delete your account and all associated data
• Sections of these Terms that by their nature should survive termination will survive
• User-generated content may remain on the platform unless deletion is requested

11. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Crap Coffee operates, without regard to its conflict of law provisions.

11.2 Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the Services:

• Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules
• Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions or class arbitrations

You agree to submit to the personal jurisdiction of the courts located in our jurisdiction for the purpose of litigating all such claims or disputes.
